And it’s official since February 21, the date of publication of the decree in the Official Journal. From April 1, the compensation ceiling will therefore go from 1.8 to 1.4 minimum wage. In short, recalling the operation: in the event of sick leave, social security covers 50% of the daily salary. The employer, for his part, pays a supplement to guarantee the employee a maintenance of at least 90% of his remuneration. But these ceilings will therefore be revised downwards. “Today, the SAPCs compensate employee sick leaves earning more than 3,243.24 euros per month (or 1.8 minimum wage) up to 53.31 euros per maximum day,” explains Noémie Marciano, director of the Health & Benefits activity at the WTW France insurance brokerage specialist. As of next month, this ceiling will be reduced to 1.4 minimum wage, which will lower the maximum compensation paid by social security to 41.47 euros per day. And this planing will not be without consequences for employers: employees being less reimbursed by social security, they will have to compensate more via their provident contracts. “Insurance that supports additional compensation will therefore most likely increase the amount of contributions paid by companies,” anticipates Guillaume Gaudiot. And the lawyer specializing in issues of social protection and remuneration is just aiming for: surveyed on the subject, “the organizations actually predict their prices on January 1, 2026, by at least 4% because of this measure,” said Noémie Marciano, during a webinar on the consequences of the social security financing bill for companies, organized this Thursday, March 13. Probable ”but could this increase in insurance costs encourage your employer to revise downward the supplement he pays you when you are sick? In theory, yes. But in practice, “it’s very unlikely”, the two experts unanimously answer us. “If an employer today grants a more generous complement than the legal minimum of 90%, it is often because it results from a collective agreement or a branch agreement,” recalls Guillaume Gaudiot. This is particularly true in large companies, where 100% maintenance of salary is frequent. However, to go back and reduce this complement, these agreements should be renegotiated with the unions. An approach that risks failing to have a categorical refusal … “A return to the legal regime could only be done after discussions with the trade union organizations, which will undoubtedly be unattractive to cut on the rights of employees”, he underlines. That said, if the care of sick leave becomes too heavy for businesses, some employers may be tempted to reopen the debate. “With a larger contribution from companies to daily allowances and provident contracts which cost more, it is not impossible that concessions be requested from the unions,” recognizes the lawyer, even if he remains skeptical about the realization of such a scenario. Clearly, for the moment, do not worry: if your employer has to bear an increase in insurance costs next year, there is little chance that this will result in a drop in your salary maintenance in the event of sick leave.
